The CCBE is troubled by the deaths of Slovakian journalist, Ján Kuciak, and his fiancée, Martina Kušnírová.

The CCBE is gravely troubled by the deaths of journalist Ján Kuciak and his fiancée, Martina Kušnírová. As an organisation, the CCBE has always placed great emphasis on the respect for human rights and the Rule of Law and we wish to express our sincere respect to the families, friends, and colleagues of the deceased. The CCBE would like to express its support to all professional journalists as, similarly to the legal profession, their work supports the Rule of Law and human rights. Indeed, the expository work of investigative journalism, which respects professional boundaries, is crucial in ensuring transparency in our societies and promoting the Rule of Law. It is with regret that the CCBE has noted the rising trend of attacks and threats against lawyers in recent years and it is gravely concerned that the deaths of Ján Kuciak and his fiancée, Martina Kušnírová, also appear to be directly linked to his activities as an investigative journalist. The CCBE believes that every state must take the necessary measures to guarantee the safety of its citizens. Especially if they come under attack for carrying out their professional activities. The independence of the media and freedom of expression are crucial components of a just and fair society. The CCBE is hopeful that Slovakian authorities will pursue a thorough and efficient investigation into these deaths and looks forwards to the subsequent revelations surrounding this brutal crime.

Le CCBE est extrêmement inquiet après la mort du journaliste slovaque Ján Kuciak et de sa compagne, Martina Kušnírová. En tant qu'organisation, le CCBE a toujours mis l'accent sur le respect des droits de l'homme et de l'état de droit. Le CCBE tient à exprimer ses sincères condoléances à la famille, aux proches et aux collègues des deux disparus. Le CCBE tient à exprimer son soutien à tous les journalistes professionnels étant donné que leur travail, comme celui de la profession d'avocat, soutient l'état de droit et les droits de l'homme. En effet, le travail d'exposition du journalisme d'investigation, dans le respect des limites professionnelles, est primordial pour assurer la transparence de nos sociétés et promouvoir l'état de droit. Council of the European Union      5/3/2018 | PRESS RELEASE Environment ministers discussed the Circular Economy and the Plastics Strategy At today's Environment Council, ministers exchanged views on the package presented by the Commission on 16 January 2018, which aims at delivering on the circular economy action plan. The package consists of the following elements: European strategy for plastics in a circular economy  a Monitoring framework for the circular economy Implementation of the Circular Economy package: options to address the interface between chemical, product and waste legislation  They based their debate on a note prepared by the Presidency and took into account the interventions of Commissioners Vella and Arias Cañete, who were present. Ministers agreed that they welcome the presentation of the new EU plastics strategy. They highlighted the need to move forward with the plastics strategy as it aims to improve how we use and recycle plastics. Plastics have been instrumental in achieving the economic and social standards we have today. However, in recent years marine littering and other undesirable consequences linked to the use of plastic have been a concern to environment ministers. All Ministers welcomed the Commission package and called for an urgent implementation of concrete measures, in particular to increase the recycling of plastics, find solutions to the widespread use of single-use plastic and to find a holistic approach to the value chain of plastic production. Eco-design for plastic products can play a very important role here. In their exchange of views, ministers mentioned several other possible actions to be taken at EU or at national levels: campaigns for raising consumer awareness increasing the quality of recycled products through setting standards green public procurement the use of the rules on Extended Producer Responsibility (EPR), similar to the one which was agreed recently in the waste package, together with financial incentives and voluntary commitments by the industry. Finally, ministers agreed that they are all looking forward to the Commission legislative proposal on single use plastics. "We need to protect our environment from plastic pollution. We also need to protect our seas from microplastic particles. Today we have made a very important first step towards commitments which will enable us to deliver on our promise to protect the environment and the health of our citizens." Neno Dimov, the Bulgarian Minister for Environment and Water On the interface between chemical, product and waste legislation, many ministers highlighted the need for availability of information on substances of concern in products. According to several speakers the same rules should apply to the content of hazardous substances in primary and in secondary raw materials, which underlines the importance of the substitution of such substances as far as possible. A number of speakers also addressed the need for more harmonised end-of-waste rules throughout the EU.  While many Ministers focused in their interventions on the plastics strategy and the interface between chemical, product and waste legislation, as suggested by the Presidency, several speakers also highlighted the importance of another element of the package, namely the monitoring framework regarding progress towards a circular economy. The proposed indicators were generally welcomed, but some ministers asked to broaden the scope of the indicators to other areas than the waste sector. In this context, they stressed the substantial contribution which the circular economy can make to the fulfilment of the climate commitments under the Paris Agreement.  Finally, Environment Ministers underlined the need to fully involve other Council formations in the discussions and the work on circular economy throughout different sectors. The Bulgarian Presidency is planning to have Council conclusions adopted on the above topics in June. The restrictive measures against two persons were not extended. This decision was based on the annual review of the measures.   The measures were initially introduced in March 2014 and extended on a yearly basis since then.

Re-registration procedures, including how to renew employment authorization documentation, have been published in the Federal Register and on the USCIS website. All applicants must submit Form I-821, Application for Temporary Protected Status. Applicants may also request an Employment Authorization Document (EAD) by submitting a completed Form I-765, Application for Employment Authorization, when they file Form I-821, or separately at a later date. Both forms are free on USCIS’ website at uscis.gov/tps. USCIS will issue new EADs with a Sept. 30, 2019, expiration date to eligible Syrian TPS beneficiaries who timely re-register and apply for EADs. However, given the timeframes involved with processing TPS re-registration applications, USCIS is automatically extending the validity of EADs with an expiration date of March 31 for 180 days, through Sept. 27. To be eligible for TPS under Syria’s current designation, individuals must have continuously resided in the United States since Aug. 1, 2016, and have been continuously physically present in the United States since Oct. 1, 2016, along with meeting the other eligibility requirements. On Jan. 31, Secretary of Homeland Security Kirstjen M. Nielsen announced her determination that the conditions supporting Syria’s TPS designation continue. The secretary made her decision after reviewing country conditions and consulting with appropriate U.S. government agencies. Before the 18-month extension ends, the secretary will review conditions in Syria to determine whether its TPS designation should be extended again or terminated. Προς την Ειδική Κοινοβουλευτική Επιτροπή «Για τη διενέργεια προκαταρκτικής εξέτασης σύμφωνα με την απόφαση της Ολομέλειας της Βουλής που λήφθηκε κατά τη συνεδρίαση της 21ης Φεβρουαρίου 2018 σχετικά με την υπόθεση Novartis»    Κυρίες και κύριοι βουλευτές - μέλη της Επιτροπής, καθώς επιλαμβάνεστε των καθηκόντων σας, θεωρώ αναγκαίο να θέσω υπόψη σας τα εξής: Α. Παραβίαση των προϋποθέσεων του άρθρου 154 παρ. 3 εδ. α΄ Κανονισμού της Βουλής - Ένσταση απαράδεκτου. Σύμφωνα με το εδάφιο α΄ της παραγράφου 3 του άρθρου 154 Κανονισμού της Βουλής «Η πρόταση για άσκηση δίωξης πρέπει να προσδιορίζει με σαφήνεια τις πράξεις ή τις παραλείψεις που σύμφωνα με το νόμο περί ευθύνης των Υπουργών είναι αξιόποινες και να μνημονεύει τις διατάξεις που παραβιάστηκαν». Στην από 12 Φεβρουαρίου 2018 πρόταση των βουλευτών του ΣΥΡΙΖΑ και των ΑΝΕΛ που έγινε δεκτή από την Ολομέλεια της Βουλής στη συνεδρίαση της 21ης Φεβρουαρίου 2018, δεν εξατομικεύονται και δεν προσδιορίζονται καθόλου οι πράξεις ή οι παραλείψεις που θεωρούνται αξιόποινες. Προσδιορισμός με σαφήνεια και βεβαίως εξατομίκευση πράξης ή παράλειψης είναι η καταγραφή των πραγματικών περιστατικών που εάν υποτεθούν αληθή πληρούν τη νομοτυπική υπόσταση διάταξης ποινικού νόμου. Ως προς το πρόσωπό μου στην από 12 Φεβρουαρίου 2018 πρόταση δεν περιλαμβάνεται καμία απολύτως αναφορά πλην αυτής που περιέχεται στο διαβιβαστικό έγγραφο της Εισαγγελέως το οποίο παρατίθεται στον πρόλογο της πρότασης. Στο πραγματολογικό μέρος της πρότασης δεν περιλαμβάνεται ούτε καν ενδεικτική αναφορά στο όνομά μου. Πολύ περισσότερο δεν μου αποδίδεται καμία πράξη ή παράλειψη η οποία να προσδιορίζεται έστω συνοπτικά αλλά με τη σαφήνεια που απαιτεί το άρθρο 154 παρ. 3 εδάφιο α΄ του Κανονισμού της Βουλής. Ούτε βεβαίως στο διαβιβαστικό έγγραφο της Εισαγγελίας περιλαμβάνεται, ούτε θα μπορούσε κατά το άρθρο 86 παρ. 2 Συντ. να περιλαμβάνεται, παρόμοιος προσδιορισμός. Ούτε είναι προσδιορισμός με σαφήνεια των πράξεων ή παραλείψεων η μνεία διατάξεων του ΠΚ που φέρονται να έχουν παραβιασθεί. Ο προσδιορισμός με σαφήνεια των πράξεων ή παραλείψεων συνιστά την πρώτη έκφανση της υπαγωγής πραγματικών περιστατικών στον φερόμενο ως παραβιασθέντα κανόνα δικαίου. Η υιοθέτηση της προδήλως αόριστης και δικονομικά απαράδεκτης αυτής πρότασης των βουλευτών του ΣΥΡΙΖΑ και των ΑΝΕΛ από την Ολομέλεια της Βουλής δεν θεραπεύει την ακυρότητα της πρότασης και της απόφασης. Αντιθέτως το γεγονός ότι η Ολομέλεια αποφάσισε να κινηθεί η διαδικασία του άρθρου 86 παρ. 3 του Συντάγματος και των άρθρων 155 επ. του Κανονισμού της Βουλής χωριστά για κάθε ένα από τα πρόσωπα που αναφερόντουσαν στο διαβιβαστικό έγγραφο της Εισαγγελέως χωρίς να στρέφεται καν ονομαστικά εναντίον τους η πρόταση των βουλευτών της κοινοβουλευτικής πλειοψηφίας, επιτείνει την ακυρότητα αυτή που είναι ούτως η άλλως απόλυτη. Η Επιτροπή σας καλείται να αναπέμψει τη σχετική απόφαση κατά το μέρος που με αφορά. Σε κάθε δε περίπτωση προβάλλω τη σχετική ένσταση και δηλώνω ότι θεωρώ άκυρη κάθε πράξη της Επιτροπή σας η οποία δεν έχει συσταθεί νόμιμα, αλλά κατά παραβίαση του άρθρου 154 παρ.3 εδ. α´ του Κανονισμού της Βουλής. Β. Εφόσον η Επιτροπή αποφασίσει να συνεχίσει, παρά την υπό Α ένσταση απαράδεκτου και ακυρότητας της απόφασης της Ολομέλεια της Βουλής στην συνεδρίαση της 21ης Φεβρουαρίου για την σύστασή της, υποβάλλω επικουρικά τις ακόλουθες ενστάσεις και αιτήματα, με τη ρητή δήλωση επιφύλαξης όλων των δικαιωμάτων μου:  1. Καθεστώς προστατευόμενων μαρτύρων - Ένσταση απόλυτης ακυρότητας της προδικασίας και της εξέτασης των ανώνυμων μαρτύρων. Θέτω υπόψη της Επιτροπής σας ότι με την από 26 Φεβρουαρίου 2018 αναφορά μου προς τον Αντεισαγγελέα του Αρείου Πάγου που εποπτεύει των Εισαγγελέων Εγκλημάτων Διαφθοράς, αντίγραφο της οποίας επισυνάπτω και ενσωματώνω στην παρούσα (Σχετικό 1), ανέπτυξα τους λόγους για τους οποίους είναι απολύτως άκυρη τόσο η υπαγωγή των ανώνυμων μαρτύρων της διαβιβασθείσας δικογραφίας στο καθεστώς προστασίας της παραγράφου 2 του άρθρου 9 ν. 2928/2001, όπως ισχύει, με διάταξη του Εισαγγελέα Πρωτοδικών, όσο και η εκ των υστέρων, μετά τη διαβίβαση της δικογραφίας στη Βουλή, χαρακτηρισμός των μαρτύρων αυτών ως «δημοσίου συμφέροντος» κατά την παρ. 1 του άρθρου 45Β του ΚΠΔ με την 3/2018 διάταξη της Εισαγγελέως Εγκλημάτων Διαφθοράς Αθηνών και την από 9 Φεβρουαρίου 2018 εγκριτική διάταξη του ανωτέρω Αντεισαγγελέα του ΑΠ. Αρμόδια να κρίνει το ζήτημα είναι πλέον, ως ο Εισαγγελέας της υπόθεσης, η Επιτροπή σας από την οποία ζητώ, για τους λόγους που αναπτύσσω στην παραπάνω αναφορά μου, την οποία καταθέτω και ενώπιον της Επιτροπή σας, να διαπιστώσει την απόλυτη ακυρότητα της φάσης της προδικασίας που συντελέσθηκε ενώπιον της Εισαγγελέως Εγκλημάτων Διαφθοράς Αθηνών και ιδίως την απόλυτη ακυρότητα των μαρτυρικών καταθέσεων χωρίς αναφορά του ονόματος, του τόπου γέννησης, κατοικίας και εργασίας, του επαγγέλματος και της ηλικίας των μαρτύρων. Κατά μείζονα δε λόγο να διαπιστώσει την απόλυτη ακυρότητα του εκ των υστέρων χαρακτηρισμού τους ως «δημοσίου συμφέροντος» από αναρμόδια όργανα. Το όνομα μου ψέλλισε μόνον ο αναφερόμενος υπό την κωδική ονομασία «Μάξιμος Σαράφης» μάρτυρας, όμως λόγω της δικονομικής συνάφειας η ένστασή μου αφορά και τους τρεις μάρτυρες. Παρέλκει να σημειώσω ότι η Επιτροπή πρέπει να ζητήσει αμέσως από τις Εισαγγελικές Αρχές, προς στοιχειώδη συμπλήρωση της δικογραφίας, τις διατάξεις του Εισαγγελέα Πρωτοδικών με τις οποίες υπήχθησαν οι μάρτυρες στην παράγραφο 2 του άρθρου 9 ν. 2928/2001 και την εκ των υστέρων εκδοθείσα διάταξη υπ’ αριθμόν 3/2018 της Εισαγγελέως Εγκλημάτων Διαφθοράς Αθηνών καθώς και την από 9 Φεβρουαρίου 2018 εγκριτική διάταξη του εποπτεύοντος Αντεισαγγελέα του ΑΠ για την υπαγωγή των ίδιων μαρτύρων στο άρθρο 45 Β παρ. 1 ΚΠΔ. 2. Κλήση για εξέταση των τριών μαρτύρων, επωνύμως.  Επικουρικώς ζητώ από την Επιτροπή σας, εάν θεωρήσει κατά πλειοψηφία ότι συγκροτήθηκε και λειτουργεί νόμιμα, να επιληφθεί εξαρχής της προδικασίας και να καλέσει προκειμένου να εξετάσει εξ υπαρχής, σύμφωνα με τον ΚΠΔ, επωνύμως και υπό συνθήκες διαφάνειας, τους τρεις φερόμενους ως προστατευόμενους μάρτυρες η ανώνυμη εξέταση των οποίων πάσχει από απόλυτη ακυρότητα και ως ανώνυμη είναι, ούτως ή άλλως, αποδεικτικά ανίσχυρη ( άρθρο 9 παρ.5 ν. 2928/2001, όπως ισχύει).  3. Κλήση για εξέταση ως μαρτύρων του Κωνσταντίνου Φρουζή και της σημερινής διοίκησης της Novartis. Στα μέσα ενημέρωσης ( ενδεικτικά Η Καθημερινή, ηλεκτρονική έκδοση 1.3.2018, Το Βήμα online 1.3.2018, iefimerida 1.3.2018) δημοσιεύθηκε η είδηση ότι ο Κωνσταντίνος Φρουζής, πρώην αντιπρόεδρος της Novartis και φερόμενος στις καταθέσεις των ανώνυμων μαρτύρων ως αυτουργός όλων των παράνομων πράξεων, κάλεσε με εξώδικο δήλωσή του (που δημοσιεύθηκε αυτούσια) την εταιρεία στην οποία εργαζόταν να αποσαφηνίσει ότι δεν είχε αρμοδιότητα και εξουσία διαχείρισης οποιουδήποτε εταιρικού λογαριασμού. Επισυνάπτονται τα σχετικά δημοσιεύματα (Σχετικό 2 ). Είναι προφανώς αναγκαίο αμέσως μετά τους τρεις μάρτυρες να κληθούν προς εξέταση ενώπιον της Επιτροπή σας ο Κωνσταντίνος Φρουζής και οι διοικήσεις της Novartis. 4. Άμεση υποβολή από την Novartis προς την Επιτροπή των δεδομένων που έλαβε άδεια να διαβιβάσει σε αρχές των ΗΠΑ. Στην εφημερίδα ΤΑ ΝΕΑ της 26ης Φεβρουαρίου 2018, σελ. 11, δημοσιεύθηκε η συνημμένη ( Σχετικό 3 ) δημόσια πρόσκληση της εταιρίας Novartis που γνωστοποιεί ότι με άδεια της Αρχής Προστασίας Δεδομένων Προσωπικού Χαρακτήρα προτίθεται να διαβιβάσει όλα τα δεδομένα που διαθέτει στο Υπουργείο Δικαιοσύνης των ΗΠΑ και την Επιτροπή Κεφαλαιαγοράς των ΗΠΑ. Όπως είναι προφανές και όπως επισήμανε με ανακοίνωσης της και η ΑΠΔΠΧ, τα δεδομένα αυτά πρέπει να ζητηθεί να υποβληθούν αμέσως στην Επιτροπή σας.  5. Γνωστοποίηση υποβολής έγκλησης και μήνυσης. Όπως ενημέρωσα και την Ολομέλεια της Βουλής στη συνεδρίαση της 21ης Φεβρουαρίου 2018, στις 20 Φεβρουαρίου 2018 υπέβαλα προς τον κ. Εισαγγελέα Πλημμελειοδικών Αθηνών την Α.Β.Μ. Γ 2018/419 έγκληση και μήνυση κατά του μάρτυρα του φερόμενου με την κωδική ονομασία «Μάξιμος Σαράφης και κατά των αυτουργών και συνεργών δέσμης ποινικών αδικημάτων που έχουν τελεσθεί σε σχέση με την έως τώρα διαχείριση της υπόθεσης Novartis. Επισυνάπτω αντίγραφο προς ενημέρωση των μελών της Επιτροπής ( Σχετικό 4). Γ. Αίτημα αυτοπρόσωπης εμφάνισης.  Τέλος, ζητώ από την Επιτροπή σας να αναπτύξω ενώπιον της, αυτοπροσώπως και προφορικώς, τις ενστάσεις που προβάλλω.
