Statement of the Council of Bars and Law Societies of Europe (CCBE) on the ongoing crackdown against lawyers in Turkey 05/04/2018

The CCBE firmly condemns the ongoing crackdown against lawyers in Turkey following the failed coup of 15 July 2016.

On this day, 5th of April – celebrated as Lawyers' Day in Turkey – the Council of Bars and Law Societies of Europe (CCBE) takes the opportunity to firmly condemn the ongoing crackdown against lawyers in Turkey. Following the failed coup of 15 July 2016, the Turkish government declared a state of emergency and adopted a series of decree-laws which led to a serious undermining of human rights and the rule of law across the country. According to the latest information available, since July 2016: - 1539 lawyers have been prosecuted - 580 lawyers have been arrested - 103 lawyers have been sentenced to lengthy imprisonment These lawyers are currently being targeted for the sole reason of carrying out their professional activities, based on alleged accusations of supporting terrorist organisations. It is estimated that more than 300 lawyers are currently detained in Turkey. In Istanbul, we understand that more than 100 lawyers are under pre-trial detention. The CCBE stresses that the independence of the legal profession is an essential component in upholding the rule of law in a free society. Indeed, lawyers play a fundamental role in ensuring the protection of human rights and fundamental freedoms. The Council of Europe recommendation on the freedom of exercise of the profession of lawyer N°R (2000) 21 from 25 October 2000 highlights that “all necessary measures should be taken to respect, protect, and promote the freedom of exercise of the profession of lawyers without discrimination and without improper interference from the authorities or the public (…)”. Furthermore, the United Nations Basic Principles on the Role of Lawyers emphasise that Governments must respect and ensure the proper role of lawyers. The CCBE urges the Turkish government to uphold the rule of law and bring an end to the persecution of lawyers. All lawyers who have unduly been detained for carrying out their professional activities should be immediately released.

COMMUNIQUÉ DE PRESSE Déclaration du Conseil des barreaux européens (CCBE) sur la répression continue des avocats en Turquie 05/04/2018

Le CCBE condamne fermement la répression continue qui s'opère à l'encontre des avocats en Turquie à la suite de la tentative de coup d'État du 15 juillet 2016.

En ce 5 avril, journée des avocats en Turquie, le Conseil des barreaux européens (CCBE) condamne avec fermeté la répression continue qui s'opère à l'encontre des avocats en Turquie. Après la tentative de coup d'État du 15 juillet 2016, le gouvernement turc a déclaré l'état d'urgence et adopté une série de décrets-lois qui ont gravement porté atteinte aux droits de l'homme et à l'état de droit dans le pays. D'après les dernières informations disponibles, depuis juillet 2016 : - 1 539 avocats ont été poursuivis ; - 580 avocats ont été placés en détention ; - 103 avocats ont été condamnés à de lourdes peines de prison. Ces avocats sont ciblés uniquement pour avoir exercé leurs activités professionnelles, sur fond d'accusations de prétendu soutien à des organisations terroristes. D'après les estimations, plus de 300 avocats sont actuellement en détention en Turquie. À Istanbul, plus de 100 avocats se trouvent en détention provisoire. Le CCBE rappelle que l'indépendance de la profession d'avocat est une composante essentielle du maintien de l'État de droit dans une société libre. Les avocats jouent en effet un rôle fondamental dans la protection des droits de l'homme et des libertés fondamentales. Comme le souligne la Recommandation du Conseil de l'Europe sur la liberté d'exercice de la profession d'avocat N° R(2000)21 du 25 octobre 2000, « Toutes les mesures nécessaires devraient être prises pour respecter, protéger et promouvoir la liberté d'exercice de la profession d'avocat sans discrimination ni ingérence injustifiée des autorités ou du public (…) ». En outre, conformément aux Principes de base des Nations Unies relatifs au rôle du barreau, les pouvoirs publics doivent respecter et veiller à ce que les avocats puissent s'acquitter de toutes leurs fonctions professionnelles. Le CCBE exhorte le gouvernement turc à faire prévaloir l'État de droit et à mettre fin à la persécution des avocats. Tous les avocats détenus de manière indue pour avoir exercé leurs activités professionnelles doivent être libérés sans délai.
