Condies Foods of Kearns, UT is recalling 166 cases of code date “USE THRU 01/05/2018,” there is a possibility that this may contain undeclared milk and egg allergens. People who have an allergy or severe sensitivity to milk and egg run the risk of serious or life-threatening allergic reaction if they consume these products.

Evershing International Trading Company Recalls Frozen Shredded Coconut Because of Possible Health Risk

Evershing International Trading Company is recalling 16 ounces Coconut Tree Brand Frozen Shredded Coconut because they have the potential to be contaminated with Salmonella, an organism which can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune system. Healthy persons infected with Salmonella often experience fever, diarrhea (which may be bloody), nausea, vomiting and abdominal pain. In rare circumstances, infection with Salmonella can result in the organism getting in to the bloodstream and producing more severe illnesses such as arterial infections (i.e., infected aneurysms), endocarditis and arthritis. No illnesses have been reported to date.

FTC staff answers questions about MLMs

Multi-level marketers sell a wide variety of products and services and they structure their companies in different ways. But there’s a lodestar that all industry members can use to navigate through issues that may arise – and here it is: Core consumer protection principles apply to all MLMs. FTC staff has just released business guidance to help MLMs apply those core principles to their business practices.

FTC Staff: Proposed Pennsylvania Legislation Affecting Nurse Practitioners Likely to Benefit Competition and Consumers while Promoting Principles of Economic Liberty

Federal Trade Commission staff submitted written comments on the competitive impact of a legislative proposal to modify the supervision requirements imposed on advanced practice registered nurse-certified nurse practitioners (APRN-CNPs) in Pennsylvania. The comments respond to a request from Pennsylvania State Representative Jesse Topper and encourage the Pennsylvania legislature to pass the legislation, which will spur competition to benefit consumers, and also promote economic opportunity for nurse practitioners.

The staff of the FTC’s Office of Policy Planning and Bureaus of Competition and Economics submitted comments regarding Pennsylvania House Bill 100, which seeks to allow the state’s Board of Nursing the authority to license APRN-CNPs to practice independently (including the ability to prescribe medications), without a physician’s supervision, if they have at least three years and 3,600 hours of practice in a collaborative arrangement with a physician. The legislation, if passed, will also permit the Board to recognize the experience of APRN-CNPs who have been practicing in another state with collaboration requirements equivalent to Pennsylvania’s.

The comment states that, “Undue regulatory restrictions on APRN practice can impose significant costs on health care consumers – patients – as well as both public and private third-party payors.” The comment further explains that FTC staff have analyzed the likely competitive effects of APRN regulations in other states, and have found that removing excessive supervision requirements can lead to significant consumer benefits. Building in part on this work, in 2017 the FTC formed the Economic Liberty Task Force that is examining a broad range of professional licensing issues and bringing to light ways to promote entrepreneurship by avoiding costly and burdensome regulations that harm competition without offering countervailing benefits to consumers.

The staff comment refers to an FTC staff policy paper, issued in March 2014, which analyzes the competitive implications of various types of APRN regulations.

FTC Staff Offers Business Guidance Concerning Multi-Level Marketing

The Federal Trade Commission staff has released business guidance to help multi-level marketers (MLMs) understand and comply with the law.

Although there may be significant differences in how MLMs sell products or services, core consumer protection principles apply to all MLMs. Among other things, the business guidance explains how the FTC distinguishes between MLMs with lawful and unlawful compensation structures, how MLMs with unfair or deceptive compensation structures harm consumers, and how the FTC treats personal or internal consumption by participants in determining if an MLM’s compensation structure is unfair or deceptive. The guidance also addresses how an MLM should approach representations to current and prospective participants.

The guidance explains that an FTC determination as to whether an MLM violates the law involves a fact-specific evaluation and a careful investigation. It also states that orders against individual MLMs are not binding on the entire industry, but the provisions of these orders may provide useful guidance.
